Indian Peaks Band of Paiutes Individual Assistance Program - FY22 - [Internal Revenue Code Section 139E] Adults must be enrolled members of the Indian Peaks Band of Paiutes. 

IMPORTANT PROGRAM NOTICE

The purpose of this application is to substantiate that federal Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund (SLFRP funds) established under the American Rescue Plan Act are used only for purposes permitted under the Interim Final Rule to implement the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund established under the American Rescue Plan Act.

The current guidance (Interim Final Rule and FAQ’s) permits to provide individual assistance in response to the public health emergency and its negative economic impact to households to the extent the household experienced a negative economic impact from the pandemic. The one-time assistance provided under this Program is intended to meet the criteria of section 602 and 603 of the Social Security Act outlined in the U.S. Treasury Coronavirus State and Local Fiscal Recovery Funds, Interim Final Rule, May 2021.

The Tribe affirms that Native Americans, especially its Tribal Members, have faced disproportionate health and economic impact from the COVID-19 pandemic which has been problematic to the socioeconomic wellbeing of our membership. The Tribe concurs with the Indian Peaks Band Council’s determination to provide individual assistance to its Indian Peaks Band membership individual assistance to those who have faced economic impact.

The Tribe has determined that assistance under this program is allowable and necessary to address negative economic impact that our membership continues to address due to COVID-19. The Tribe has determined that it is administrative necessary, based on tribal staffing and operations during the pandemic, the need to promote social distancing and mitigation efforts, and to address urgent needs in a timely manner to process individual assistance payments to those individual who confirm they have experienced a negative economic impact from COVID-19; and (2) individual assistance amounts correlate to the guidance, and the per person amounts previously provided by the Federal government in response to the COVID-19 crisis.

The purpose, and eligible use, of the individual assistance is to address the negative economic impact related to: food assistance; rent, mortgage, or utility assistance; counseling and legal aid to prevent eviction or homelessness; emergency assistance for burials, home repairs, weatherization, or other needs; internet access or digital literacy assistance; or job training to address negative economic or public health impacts experienced due to a worker’s occupation or level of training, all in consideration to the extent which the household has experienced a negative economic impact from the pandemic.

Federal Income Tax. The Paiute Indian Tribe of Utah has structured this Program with the intent that the financial assistance received by an Eligible Tribal Member is not subject to federal income tax. Specifically, the Tribe intends for the financial assistance payments provided under this Program to the Tribal General Welfare Exclusion Act of 2014 (the “GWE”). Please keep in mind, however, that this is not a “per capita” payment. All payments must be used for necessary COVID-19 expenses that meet the federal ARPA SLFRP requirements.

Effect on Other Assistance. A Tribal Member’s receipt of financial assistance under the Program may affect that member’s eligibility for other need-based assistance. While the Tribe has structured the Program to minimize members’ individual tax burden and any effects on the receipt of other assistance, IT IS THE SOLE RESPONSIBLY OF THE APPLICANT TO DETERMINE THE EFFECTS, IF ANY, THE HOUSEHOLD ASSISTANCE HAS ON OTHER ASSISTANCE BENEFITS.

Information contained in this application is confidential and will only be used for official tribal and regulatory compliance purposes, which may include audits by the Office of the Inspector General and the IRS. Applicants must complete an individual program application and confirm that they have experienced a negative economic impact due to the COVID-19 pandemic to be eligible to participate in this program.

The United States Office of the Inspector General has indicated that compliance with ARPA SLFRP funds requirements will be monitored through compliance audits, and we want to make sure that the Tribe and Tribal members are in the best position possible to substantiate compliance.

The Indian Peaks Band Council has approved a $2,000 direct payment to all enrolled Indian Peaks Band members who have experienced a negative economic impact due to the COVID-19 pandemic and $1,000 for each dependent child. Band member minors if not on adult application are also approved for $1,000.00

Applicants must be enrolled and 18 years or older at the time of submitting this application.
